What Is A Bail Bond?
A bail bond is the document that is presented to the court to secure the release of a defendant who is in custody, and to ensure the appearance of the defendant at all required court hearings.
How Do I Get A Bail Bond?
There are three types of bail bonds used to secure a defendant’s release from jail: personal recognizance, cash bond and a professional bondsman or bonding company.
What Are The Three Types Of Bail Bonds?
- Personal Recognizance (PR Bonds) - A PR bond is a signature bond that involves no money or property as long as the defendant appears at all future court dates. A judge’s order must be obtained for a person to be released on a Personal Recognizance Bond.
- Cash Bond - A cash bond requires the full bail amount be paid by cash, money order, cashier’s check or credit card either by the defendant or another person and is not financed through a bail agent. The court will hold onto the full bail amount until the criminal case is concluded.
- Professional Bondsman (Surety Bond) – The bondsman secures the release of a person from custody and pledges to assure their future appearances(s) before the Court. In return, a non-refundable premium is paid to the bail bondsman. The contract between an individual and their bail bondsman is a private matter and not subject to the control of the Court.
How Is The Bail Amount Determined?
The bail amount is set by the judge or panel of judges in the jurisdiction where the alleged offense occurred.
How Can I Pay For A Bail Bond?
Acceptable forms of payment are typically cash, money order, cashier’s check or credit card. If bond is paid by money order or cashier’s check, the money order or cashier’s check shall be made payable to the holding jurisdiction.
What Fees Are Associated With Posting A Bond?
There is a non-refundable $10.00 Bond Fee that will be assessed at the time an appearance bond is posted. The $10.00 Bond Fee is chargeable as a debt to the defendant after release if the payor chooses not to pay the fees at the time of bonding.
What Happens If The Defendant Doesn’t Appear For Court?
If the defendant does not appear at the next setting after posting a bond, the court will order the bond forfeited and a new warrant will be issued for the defendant’s arrest.
When Will The Bond Money Be Released To The Posting Party?
Upon final disposition of a case, a bond may be ordered to be released. All bond refunds are issued in the form of a check from the City of Aurora. The Court may first take money from the bond towards payment of any outstanding fines and costs. If the bond amount is more than is owed in the defendant’s case, the difference will be refunded in the form of a check from the City of Aurora within three to four weeks by mail. If the bond is less than the amount owed in the defendant’s case, the defendant must pay the difference. If a Bail Bond Agent or other type of professional bond is used, the bond is not applied to fines and costs. Bond refunds are issued in the form of a check and are mailed from the City of Aurora within three to four-weeks following the disposition of the case. IMPORTANT: Immediately inform the Court if you move or any of your contact information changes to ensure the refund check is mailed to the correct address
